Construction Law [Top]

David has years of experience in the field of construction law. He has assisted contractors and owners in all facets of the life-cycle of a construction project, from the negotiation and preparation of contracts during the planning stages, to advice and counsel on specific issues that arise during construction, to litigation and arbitration arising at the end of the project. David has assisted construction clients with a wide range of construction issues and disputes, including improper termination, contract default, lien filings, construction defects, EIFS claims, lien foreclosure, payment disputes, pay-if-paid clause enforcement, surety claims, and many others.

Contract Preparation and Negotiation [Top]

Whether it’s editing industry standard contracts to better suit your business, or preparing independent contract documents to protect your interests, David can negotiate and prepare all of your contract documents. David has experience negotiating and drafting all kinds of commercial contract documents, including leases, purchase and sale documents, and large and complex construction contracts. David has extensive experience with the American Institute of Architecture (“AIA”) contract forms, including lecturing and writing about the impact of the specific contract terms in those documents, and how certain contract parties can best alter those standard terms to their benefit.

David is a seasoned trial attorney with fifteen years of litigation experience helping clients manage their actual and potential liabilities. He has led litigation teams representing a broad spectrum of clients and issues in numerous different state and federal courts. His practice has allowed him to garner proficiency managing litigation and pre-litigation matters ranging from small disputes to large, multi-party disputes with millions of dollars in controversy. He has also conducted numerous mediations, early neutral evaluations, and court mandated settlement conferences to help clients avoid the risks and expense of continued litigation.

Business Formation and Business Law [Top]

David can assist in the formation of your business, as well as many other issues which arise during the life of your company, including dissolution and ownership transfers. David can assist not only by drafting by-laws, operating agreements, company policies, leases, contracts, purchase order conditions, and other documents and agreements necessary for the prosperous operation of your business, but also by helping you avoid risk and resolving disputes.

David has assisted clients with protests and claims in all levels of government, from local concession bids to federal construction contracts. He has represented contractors in a variety of government contract issues, including bid preparation, bid protests, requests for equitable adjustment and other contract claims.

Charged as a flat monthly fee, these services include all the services available from David C. King, LLC, including contract review, negotiation, and formation, corporate governance, litigation avoidance, insurance consultations, and general legal advice on other issues which may arise in the day-to-day operation of your business. The only matters not included within the monthly flat fee are non-routine matters, such as major transactions or disputes that cannot be resolved prior to litigation.

David has extensive experience in the insurance industry. He is a former partner of a large, prestigious Atlanta insurance firm, and has many years of experience analyzing and litigating insurance claims and insurance coverage disputes for both insureds and insurers. He has written and lectured on many insurance topics, including the changing dynamics of the “your work” CGL exclusions. He has served for several years on the governing board of the State Bar of Georgia’s Tort and Insurance Practice Section. He is presently the Immediate Past Chair of that practice section.

During his fifteen years of practice, David has assisted many contractors, business owners, and individuals, as well as their insurers, in defense of covered personal injury and property damage claims. David has extensive contacts in the insurance industry and currently holds the position of Immediate Past Chair of the Georgia Bar’s Tort and Insurance Practice Section. He understands the particular financial issues specific to insurance defense cases, and the needs of insurers to obtain competent legal services for their insureds in an efficient and economical fashion. He also understands how to walk inexperienced insureds through the minefield of litigation.

Non-Profit Formation and Governance [Top]

David can assist you in forming, starting, and governing foundations, public charities, and other non-profit organizations. He can offer advice about proper entity structure, prepare your 501(c)(3) application and other government documentation, and assist you with the creation of the proper governance practices and policies necessary for the efficient and complaint operation of your charitable entity.
